General notions about restorativa justice

Abstract

Introduction: Restorative Justice is a very new practice, difficult to conceptualize. Therefore, there are several ways to understand what restorative justice means. This is explained by the very nature of its concept: it is open-ended, still under construction, and largely established.  

Objective: To understand the concept of restorative justice, its values, and principles. Then, to observe how it is treated and applied in Brazil. 

Methods: Two methodological strategies were used to undertake this research: bibliographical research and documentary research. Furthermore, the deductive method was employed. 

Results: Restorative Justice's main practices are victim-offender mediation, restorative circles, and family conferences; these aim to replace the punitive model with a more humane, participatory, and transformative justice. It is an open concept, constantly evolving, based on values such as empowerment, reparation, and dialogue between the parties involved in the conflict.  

Conclusion: Thus, in Brazil, we do not yet have a federal law that regulates JR, however, there are national legal provisions in which we find grounds for the use of JR, either by express determination or through hermeneutics.
