From the paradoxes of rights to the counter-rights of children

Abstract

This article discusses children’s rights from the point of view of what they mean for children and how they can be used by children in their own interests. One obstacle to this is that the discourse on rights assumes that they apply to all people in the same way and have the same meaning for them. To overcome the mystification associated with rights, the article analyses what it means to regard children as legal subjects, which legal paradoxes need to be considered and how they should be addressed. The article comes to the conclusion that children are best able to make their rights their own if they are conveyed together with their living conditions and experiences and are conceptualised as counter-rights.

Manfred Liebel, Universidade de Potsdam, Alemanha

Sociologist, Doctor of Philosophy, Professor Emeritus of Sociology. He is currently Honorary Professor of Intercultural Childhood Studies and Children's Rights at the University of Applied Sciences in Potsdam, Germany. He is also a consultant for NGOs that work with children and young people; the Latin American Network of Masters in Public Policies and Children's Rights; and the Movimientos de los Niños, Niñas y Adolescentes Trabajadores (ProNATs).
